And on the other hand, any individual wishing to make a purchase on the web site «coussinthailandais.com» which can be used on the following link : https://www.coussinthailandais.com/ and hereafter named “the customer”.
It is expressly stated that the website “www.coussinthailandais.com” is exclusively intended for individual customers. Consequently, no wholesale transactions, resale, or special pricing conditions for professionals are offered on this website. The products are packaged and sold solely for personal use.
The following conditions govern the sale of any product shown on the «coussinthailandais.com» website by the LENOSPHERE company. The co-contracting parties agree that their relationships will be exclusively governed by the following contract, excluding any other condition. Any order placed properly on the «coussinthailandais.com» website implies the complete acceptance without any reservation of the hereafter general conditions of sales, and possibly of the specific conditions to one or many products or orders.
1. PURPOSE OF THE CONTRACT
1.1 The following conditions seek to define the parties’ obligation and the different steps of the order procedure.
2. PRODUCTS
2.1. The photos on the website are not contractual, the patterns and colors of the delivered products can slightly vary.
2.2. All handcrafted products may vary in design, color, size and weight.
3. IF A PLACED ORDER CONCERNS A PRODUCT WHICH BECAME OUT OF STOCK
3.1. The products visible on the website will be available until stocks are exhausted or are no longer made. As a result, the LENOSPHERE company does not guarantee in any case the availability of products offered on the website during a given period. Any claim from clients about the order or the delivery of no longer available goods will be considered as clearly unfounded.
3.2. In case of a stock out, the LENOSPHERE company will exchange the product or refund the customer of the amount of the product. In both cases, LENOSPHERE will inform by email the customer who would have placed an order of a non longer available product.
4. PRODUCT PRICING
4.1. Prices are presented in euros (€) and are displayed without including taxes. Customs duties and taxes are likely to be due. It is in the customer's responsibility to pay them and to obtain further information from the competent authorities on the duties and payable taxes. LENOSPHERE is not obligated to verify or inform the customer about applicable customs duties and taxes in their country.
5. PAYMENT
5.1. Once the payment has been received by the E-transactions system, it will be considered as an irrevocable contract between the parties.
5.2. The payment will be made in euros (€).
5.3. LENOSPHERE company shall acknowledge receipt of the order as soon as it has been validated by an e-mail or any other means of communication.
6. DELIVERY
6.1. As part of its environmental commitment and to reduce the carbon footprint associated with transportation, the company LENOSPHERE reserves the right to consolidate several orders placed by the same customer within a short period into a single shipment, where technically feasible. By accepting these terms and conditions of sale, the customer acknowledges and agrees to this eco-responsible approach.
6.2. The parcel will be shipped with tracking, and a tracking number will be assigned. This number will be sent to the customer by email, allowing them to track their parcel on the website of the Thai postal service or that of the postal operator in the destination country.
6.3. Delivery of the products is estimated at approximately 14 to 28 days by air from the departure of the goods from our warehouse, followed by handling by local postal services. The delivery times indicated on the website are provided for informational purposes only and do not constitute a firm contractual commitment on the part of LENOSPHERE. Consequently, LENOSPHERE shall not be held liable for any delay in delivery resulting from circumstances beyond its control, including those related to postal services, customs authorities, or any unforeseen event or force majeure. Any extension of the delivery period shall not, under any circumstances, give rise to order cancellation, damages, or any other compensation in favor of the buyer.
6.4. The order will be delivered to the address provided by the customer in the order form. In the event of absence at the time of delivery of a bulky parcel, the customer must collect their order from their nearest post office with proof of identity. Depending on the country of residence, after a certain period, the local postal service no longer retains the parcel, and it will become the property of the Thai postal service. The company LENOSPHERE shall not be held liable if the customer fails to take the necessary steps to collect the parcel within the time limit set by the local postal service. Any claims made after this period will be rejected.
6.5. It is the customer’s responsibility to verify with the competent authorities of their country that the ordered product complies with applicable regulations and is authorized for import. The company LENOSPHERE disclaims any liability in the event of refusal by customs authorities.
6.6. In the event of a parcel being held by customs, it shall be the customer’s responsibility to resolve the issue. The company LENOSPHERE disclaims any obligation in relation to this procedure.
6.7. The company LENOSPHERE shall not be held liable in the event of error, false declaration, omission, or inaccuracy in the delivery information provided by the customer (incomplete, incorrect, or misspelled address, invalid phone number). It is the customer’s responsibility to verify the consistency between the actual destination and the country selected at the time of ordering. Certain destinations (autonomous territories, dependencies, or areas not administratively attached to a main country) are not eligible for delivery. Any false declaration regarding the selected country or delivery area, as well as any failure to indicate the actual destination, shall not engage the liability of LENOSPHERE. In the event of an inability to deliver for these reasons, the parcel will be returned and handed over to the Thai postal service, which will become its owner, without the possibility of refund, reshipment, or compensation.
6.8. Any parcel marked as delivered by the postal service but not received by the customer must be the subject of a claim by the customer with the postal service of the destination country. The company LENOSPHERE will provide the customer with all necessary documents to support this process in order to obtain compensation.
6.9. In the event of receipt of a damaged parcel, the customer must clearly report it in writing on the carrier’s delivery note at the time of receipt. The customer must also provide photographic evidence of the parcel before opening it, as well as photos of the damaged items.
6.10. In the event that the customer refuses to accept the parcel at the time of delivery due to non-payment of customs duties, taxes, or related charges, the parcel shall be returned and handed over to the Thai postal services. It will then be considered abandoned and become their property. No refund, reshipment or compensation may be claimed in this case.
7. LOSS OF PARCEL
7.1. A parcel may only be considered lost after the completion of an official investigation procedure initiated with the relevant postal operators. The initiation of this investigation is a mandatory prerequisite for any request for refund or reshipment. The customer agrees to fully cooperate in this procedure and to provide all information necessary for its proper conduct.
7.2. The customer is informed that investigation timeframes may vary depending on the postal services and may extend over several weeks. No request for refund or replacement may be processed before the official closure of said investigation.
7.3. A full refund of the order or, at the seller’s discretion, reshipment of the products, may only take place on the express condition that written confirmation of the parcel’s loss is issued by the competent postal services.
7.4. In the event that, following the investigation, the parcel is located, in transit, or not recognized as lost by the postal services, no request for refund, cancellation, or replacement shall be accepted. The customer will then be required to wait until the effective delivery of the parcel.
8. CANCELLATION OF ORDER AND RETURN OF GOODS
8.1. The customer has the option to cancel their order prior to shipment. However, bank fees may be applied by the financial institution, including currency exchange fees (Thai Baht conversion rates) and credit/debit card transaction fees, which shall remain the sole responsibility of the customer.
8.2. Once the order has been shipped, no cancellation or refund requests will be accepted.
8.3. Items that are made to order, customized, or currently in production are not eligible for exchange or refund.
8.4. After receipt of the order only for a defective product or a product not in conformity with the order the customer can ask to be reimbursed or for the product to be exchanged within 7 clear days of receipt of the reception date of one or many products and without penalty except from the return fees. The refund will take place upon restitution of the product and discovery of the defect.
8.5. The returned item(s) must be sent back to LENOSPHERE within the specified period, using tracked mail, along with proof of receipt and the order number. No return will be accepted without these elements.
9. PERSONAL INFORMATION
9.1. We place the highest importance on the confidentiality of our customers' information. All collected data is handled with the utmost confidentiality and is used solely for processing orders. No information is shared with third parties.
10. INTELLECTUAL PROPERTY
10.1 All elements appearing on this website, including texts, descriptions, photographs, images, logos, illustrations, files, or any other content, are the exclusive property of LENOSPHERE or are used with proper authorization.
